Leasehold and freehold — what foreign buyers should know

Foreigners cannot hold freehold (Hak Milik) title in Indonesia — by law, that title is reserved for Indonesian citizens. Most villas for sale in Bali available to international buyers are therefore structured as leasehold (Hak Sewa), typically 25–30 year terms with extension clauses. Other legal pathways include Right to Use (Hak Pakai) for KITAS or KITAP holders and PT PMA company ownership of HGB title for commercial use. Where a listing is described as "freehold," it refers to the underlying title held by the Indonesian owner — Fullers will always explain exactly what structure a foreign buyer can legally take, and which fits your residency and exit plan.
